Weemotely - Terms of Service

1. Introduction
 

1.1 Platform Description

Weemotely a product of WEEMOTELY - FZCO operates as a digital freelancing platform, serving as a bridge between freelancers and clients, enabling clients to post projects and freelancers to apply and submit their work through the platform. The platform provides a myriad of services including but not limited to project posting, project application, negotiation, and communication features to facilitate the collaboration between clients and freelancers.

1.2 Acceptance of Terms

By accessing or using the Weemotely platform ("Platform") a product of WEEMOTELY - FZCO, you agree to comply with and be legally bound by the Terms of Service set forth in this document ("Terms of Service"), whether or not you become a registered user of the Services. These Terms govern your access to and use of the Platform and constitute a binding legal agreement between you and Weemotely.

1.3 Changes to Terms

Weemotely reserves the right, at its sole discretion, to modify, discontinue, or terminate the Platform or Services or to modify these Terms, at any time and without prior notice. Notification concerning the modification will be communicated if necessary by Weemotely through the platform or by email. By continuing to access or use the Platform or Services after we have posted a modification or have provided you with notice of a modification, you are indicating that you agree to be bound by the modified Terms. If any platform user sees the modification as non-compatible with them they can choose to cease usage of the platform or comply with the updated Terms of Service.

1.4 User Responsibility

It is the responsibility of the user to read, understand, and accept these Terms of Service before using the services provided by Weemotely. If the user does not agree with any part of these Terms of Service, they must not use the Platform or any Services provided by Weemotely.

1.5 Eligibility

The Platform is intended solely for persons who are 18 or older. Any access to or use of the Platform by anyone under 18 is expressly prohibited. By accessing or using the Platform, you represent and warrant that you are 18 or older. If a user performs any type of age falsification or proves to be using the platform while they are below 18, then Weemotely reserves the right to terminate the user’s account without prior notice or explanation.

 

2. Definitions
 

For the purpose of these Terms of Service, the following terms shall have the meanings specified below:

2.1 Platform / Weemotely

“Platform” or “Weemotely” refer to the digital freelancing platform that connects freelancers to clients, allowing for the posting, applying, and submission of projects. Weemotely is a property of WEEMOTELY - FZCO.

2.2 User

“User” refers to any individual or entity that accesses or uses the Platform, whether as a guest or a registered user. Users may be Clients and/or Talent.

2.3 Client

“Client” refers to a User that is registered as platform as Client and whom posts a project on the Platform seeking services from Freelancers.

2.4 Freelancer/Talent

“Freelancer/Talent” refers to a User that is registered on the platform as Talent and whom applies to projects and offers services to Clients through the Platform.

2.5 Services

“Services” refers to any act performed by a Freelancer for a Client through the Platform, as described in the posted project.

2.6 Project

“Project” refers to any job posted on the platform which will contain either one or multiple tasks. The Project is posted by a Client on the Platform seeking to obtain services from Freelancers.

2.7 Agreement

“Agreement” refers to the contractual relationship formed between a Client and a Freelancer when a Freelancer accepts a project posted by a Client on the Platform.

2.8 Content

“Content” refers to text, graphics, images, music, software, audio, video, information or other materials available on the Platform.

2.9 Dispute

“Dispute” refers to a claim raised by either Client or Freelancer when certain disagreements or conflicts occur on the platform.

2.10 Dispute Resolution

“Dispute Resolution” refers to the process set forth by Weemotely to resolve disputes between Clients and Freelancers related to services obtained through the Platform.

2.11 Fees

“Fees” refers to the amount payable by a Client to a Freelancer for the completion of a project, and any other fees or charges incurred by the User in connection with the use of the Platform.

 

3. User Accounts
 

3.1 Account Creation

To access and use certain features of the Platform, Users may be required to register for an account. Users agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. Weemotely reserves the right to request from users to provide additional information and verification without a need for justification.

3.2 Account Security

Users are responsible for maintaining the confidentiality of their account credentials and are solely responsible for all activities that occur under their accounts, whether or not authorized. If a User suspects any unauthorized use of their account, they must immediately notify Weemotely.

3.3 Account Termination

Weemotely reserves the right to suspend, disable, or terminate any User account at its sole discretion, without prior notice, if Users violate any provisions of these Terms of Service or if their actions are harmful to the Platform or its Users.

3.4 Account Responsibilities

Users are responsible for all content posted and activity that occurs under their account (even when Content is posted by others who have access to their account). Users may not engage in unacceptable use of the Platform, which includes, without limitation, use of the Platform to: disseminate or transmit spam, violate any law, defame third parties, etc., misrepresent their identity or affiliation with any person or organization.

3.5 Account Limitation

Weemotely may, in its sole discretion, create limitations for accounts, including but not limited to, limiting the number of projects a User can post, limiting the number of applications a Freelancer can submit, etc., to ensure the smooth and fair operation of the Platform.

3.6 User Content

Users retain all rights to the Content they post on Weemotely. However, by posting Content, Users grant Weemotely a non-exclusive, royalty-free, perpetual, irrevocable, and sub licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display such Content throughout the world in any media.

3.7 Prohibited Activities

Users are strictly prohibited from using the Platform for activities that: violate any laws, infringe upon the rights of others, involve in fraudulent or harmful activities against any other Users or the Platform itself.

 

4. Services
 

4.1 Description of Services

Weemotely offers a range of services to facilitate the connection between Clients and Freelancers, allowing them to collaborate effectively and efficiently. The platform enables Clients to post projects, Freelancers to offer their services, and both parties to communicate, negotiate, and finalize agreements. The Services also include features such as project management tools, payment processing, and dispute resolution to ensure smooth transactions and satisfactory outcomes for all Users.

4.2 Posting Projects

Clients can post public projects describing the scope, deliverables, deadlines, and other relevant details. They can review proposals from Freelancers that applied to the project and select the ones they find suitable. Once a Freelancer is selected, Clients can utilize the platform’s tools and features to manage the project and communicate with the Freelancer. Clients have also the ability to post private projects in order to invite targeted Freelancers to view and possibly apply to the projects. To note that a Client can also invite Freelancers to public projects. Clients are prohibited from posting public or private projects seeking medical consultation or remote medical services, as these are not supported industries on Weemotely.

Freelancers can browse through posted projects or invited projects and submit proposals for the ones they are interested in. They can communicate with Clients to understand project requirements better and negotiate terms, deadlines, and payment. Freelancers are responsible for delivering quality work on time and addressing any concerns raised by the Clients. However, Weemotely does not provide the services listed on the Platform and are not responsible for the quality of work delivered. Medical Services and Consultations fall outside the permissible industries on Weemotely. Freelancers offering such services may face account suspension or termination without prior notice.

4.4 Payment

Weemotely provides secure payment processing to facilitate transactions between Clients and Freelancers. Users can make and receive payments through the platform with confidence, knowing that their financial information is protected.

4.5 Dispute Resolution

In the event of a dispute between a Client and a Freelancer, Weemotely offers a dispute resolution service to assist both parties in reaching a fair and amicable resolution. The dispute resolution process is designed to be impartial, transparent, and timely, ensuring that all Users have an opportunity to present their case.

4.6 Modifications to Services

Weemotely reserves the right to add, modify, suspend, or discontinue any Services at any time, for any reason, without notice or liability to the Users.

 

5. User Obligations
 

5.1 Compliance with Terms

Users are required to comply with all terms, conditions, and policies of the Weemotely platform. Any non-compliance may result in restrictions, suspension, or termination of access to the platform.

5.2 Accurate Information

Users must provide accurate, current, and complete information during the registration process and update such information to maintain its accuracy. Providing false or misleading information may result in restrictions, suspension, or termination of access to the platform. Weemotely reserves the right to request additional verification from users without a need for justification.

5.3 Account Security

Users are responsible for maintaining the confidentiality of their account information, including their password, and are fully responsible for all activities that occur under their account. Users agree to immediately notify Weemotely of any unauthorized use of their account or any other breach of security.

5.4 Respectful Interaction

Users must interact with each other respectfully and professionally. Any form of harassment, discrimination, or abuse will not be tolerated, and may result in immediate account suspension or termination.

5.5 Service Delivery

Freelancers are obliged to deliver services as agreed upon with the client. Failure to meet the agreed-upon terms may result in dispute process with dispute resolution proceedings determined by Weemotely which can possibly result in account restrictions, suspension, or termination.

5.6 Payment Obligation

Clients are required to pay for the services rendered by freelancers through the platform promptly upon job start. Non-payment or delayed payment may result in account restrictions, suspension, or termination and legal actions.

5.7 Content Responsibility

Users are solely responsible for the content they post on the platform, including its legality, reliability, and appropriateness. Users must have all necessary rights to the content they post and agree not to post content that infringes or discriminates upon the rights of others.

5.8 Use of Platform

Users must use the Weemotely platform in accordance with applicable laws and regulations. Any illegal or unauthorized use of the platform will result in immediate account suspension or termination.

 

6. Fees and Payment
 

6.1 Service Fees

Weemotely implements a tiered commission structure applicable to the earnings of freelancers. This structure is designed to facilitate the deduction of service fees in a manner that is transparent and equitable. Freelancers on the Weemotely platform get paid upon the finalization of each task within the project with the amount related to the task post commission deduction. The commission is calculated based on the cumulative earnings of a freelancer on the platform and is applied as follows:

For Earnings up to $2,500.00: A commission of 15% is applied to the initial earnings of each freelancer up to $2,500.00. This fee is automatically deducted from the payment for services rendered.

For Earnings between $2,500.01 and $12,500.00: Earnings within this range are subject to a commission of 10%. This rate applies to the total amount billed within this bracket.

For Earnings exceeding $12,500.01: A reduced commission of 5% is applied to earnings beyond $12,500.01.

6.2 Payment Escrow and Release

Upon completion of project negotiations, Weemotely will securely hold the agreed project funds in escrow from the Client. Following the successful completion and closure of the project, and ensuring both parties' satisfaction, the payment will be released to the Freelancer's wallet, minus applicable fees as outlined on our Pricing page.

6.3 Payment Methods

Users can make payments using various methods available on the platform, including credit cards, debit cards, and other online payment methods. Users are responsible for any fees charged by their financial institution in connection with the use of the platform.

6.4 Withdrawal Methods

Weemotely provides withdrawal methods for freelancers based on their country of location when performing the sign-up process. The withdrawal fees are paid by the freelancers and mentioned clearly while performing the withdrawal action. Thus, Weemotely advises Freelancers to accumulate relevant amounts before making a withdrawal. Withdrawals are usually delivered within 5 to 7 business days.

Please be aware that withdrawal transactions, in the form of bank transfers, are subject to $15 transfer fees, which will be deducted from the total withdrawn amount. It is important to note that this fee does not include charges of the receiving bank, meaning that the receiving bank may still charge fees depending on their policy.

In instances where a bank transfer isn't feasible, we offer an alternative option of transferring your payment to some digital wallets. This ensures that you have access to your earnings in a way that best suits your needs. Note that the digital wallet transfer fees might differ from the bank withdrawal transfer fees. 6.5 Payment Verification

Weemotely may use third-party services to verify the information provided by users for payment purposes. Users must provide accurate and complete payment information to avoid any delays or failures in processing payments. Any form of unknown or malicious payments will subject the user’s account to possible restrictions, suspension, or termination.

6.6 Refund Policy

All payments made on the platform are non-refundable, except as expressly provided in these Terms of Service. Users agree not to initiate any chargebacks without first attempting to resolve the dispute through Weemotely's dispute resolution process.

6.7 Disputes

Any disputes related to payments must be submitted to Weemotely within a specified period after the payment is made. Weemotely will review the dispute and decide in accordance with its dispute resolution policies.

6.8 Late Payments

Clients are required to make payments promptly upon project start. Any delayed or incomplete payments may result in additional charges, account restrictions, suspension, or termination.

6.9 Taxes

Users are responsible for any taxes associated with the use of the platform. Weemotely does not withhold taxes from payments made by clients to freelancers and it is the user's responsibility to assess, collect, report, or remit the correct tax to the appropriate tax authority.

6.10 Currency

All transactions on the platform are conducted in the US Dollar. Client payments on Weemotely will be processed in the currency previously mentioned, and Freelancer withdrawals will also be conducted in the same currency as well. Users are responsible for any currency conversion fees charged by their financial institution. Weemotely reserves the right to add additional currencies later on in the future.

 

7. Intellectual Property Rights
 

7.1 Ownership

Weemotely or its licensors are owners of all intellectual property rights in and on the Platform as well as the Services. The Platform and Services are licensed, not sold, to the Users, and Weemotely and its licensors retain ownership of all copies of the Weemotely software and Applications even after installation and usage on the Users' personal computers, mobile handsets, tablets, and/or other relevant devices.

7.2 Restrictions

Users may not use any intellectual property contained in the Platform or Services for any purposes other than those expressly permitted by these Terms of Service. Users may not modify, rent, lease, loan, sell, distribute, or create derivative works based on the Platform or Services, unless Weemotely has given specific written permission and consent.

7.3 Content Ownership

All content posted or submitted by Users to the Platform, including but not limited to, projects, proposals, and user profiles, remains the intellectual property of the User who submitted it. However, by posting or submitting content to the Platform, the User grants Weemotely a perpetual, irrevocable, worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, create derivative works of, display, and perform the content in connection with the Platform and Services.

7.4 Trademarks

"Weemotely" and other related graphics, logos, service marks, and trade names that mentioned the words Weemotely or even Weemotely only used on the Platform are the trademarks of Weemotely - FZCO and may not be used without permission in connection with any third-party products or services. Other trademarks, service marks, graphics, and logos used in connection with the Platform and Services may be the trademarks of their respective owners.

7.5 Infringement

If any User believes that their intellectual property rights have been infringed upon by any content on the Platform, they must promptly notify Weemotely in writing, providing a detailed description of the alleged infringement, and Weemotely will investigate and address such claims in accordance with applicable laws. And in accordance Weemotely will have the right to take necessary legal action as well as terminate or suspend the account(s) deemed plausible.

 

8. Confidentiality
 

8.1 Definition of Confidential Information

Confidential Information refers to all information disclosed by one party to another, whether orally or in writing, that is designated as confidential or that reasonably should be understood to be confidential given the nature of the information and the circumstances of disclosure. Such information includes, but is not limited to, business and marketing plans, technology and technical information, product plans and designs, and business processes, as well as any other information deemed as confidential by its owner.

8.2 Protection of Confidential Information

Users are obligated to maintain the confidentiality of all Confidential Information they receive and must not disclose or use such information without the express written consent of the disclosing party. Users are also responsible for taking all reasonable steps to ensure the protection of Confidential Information and to prevent any unauthorized use or disclosure thereof.

8.3 Exceptions

The obligations in this section will not apply to any information that: (i) is or becomes generally known to the public without breach of any obligation owed to the disclosing party; (ii) was known to the receiving party prior to its disclosure by the disclosing party without breach of any obligation owed to the disclosing party; (iii) is received from a third party without breach of any obligation owed to the disclosing party; (iv) was independently developed by the receiving party; or (v) is required to be disclosed by the law.

8.4 Duration of Confidentiality Obligation

The duty to maintain the confidentiality of the Confidential Information remains for a period of two (2) years after the termination of the user’s account or the conclusion of services rendered through the Platform, whichever occurs later.

8.5 Breach of Confidentiality

Any breach of the confidentiality obligations set forth in this section will be considered a material breach of these Terms of Service, and the disclosing party has the right to seek appropriate remedies including injunctive relief and damages.

 

9. Limitation of Liability
 

9.1 General Limitation

Neither Weemotely nor any of its affiliates, directors, employees, or other representatives will be liable for damages arising out of or in connection with the use of the Platform or the Services, which also includes the projects delivered on the Platform. This is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties.

9.2 Indirect Damages

Under no circumstances shall Weemotely be liable for any indirect, special, incidental, consequential or punitive damages, including but not limited to, loss of use, loss of profits, or loss of data, whether in an action in contract, tort (including but not limited to negligence), or otherwise, arising out of or in any way connected with the use of or inability to use the Platform or the Services, which also includes the projects delivered on the Platform.

9.3 Cap on Liability

Notwithstanding any damages that you might incur, the entire liability of Weemotely and any of its suppliers under any provision of these Terms and your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by you through the Platform or $500, whichever is lesser.

9.4 Basis of the Bargain

The limitations and exclusions of liability set forth in this section shall apply regardless of whether the liability arises from breach of contract, tort (including negligence), breach of warranty, or any other legal theory, and regardless of whether Weemotely has been advised of the possibility of such damages. The limitations and exclusions are an essential basis of the bargain between the parties and shall survive and apply even if any remedy is found to have failed its essential purpose.

 

10. Indemnification
 

10.1 General Indemnification

Users agree to defend, indemnify, and hold harmless Weemotely, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to the user’s violation of these Terms of Service or use of the Platform, including, but not limited to, user’s submissions, any use of the Platform’s content, services, and products other than as expressly authorized in these Terms of Service or use of any information obtained from the Platform.

10.2 Cooperation

Weemotely shall provide notice to you promptly of any such claim, suit, or proceeding and shall have the right to control the defense of such action, at your expense, in defending any such claim, suit, or proceeding. You agree to cooperate with Weemotely in defending any such claim, suit, or proceeding.

 

11. Dispute Resolution
 

11.1 Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the jurisdiction in which the Platform operates, without regard to its conflict of law principles.

11.2 Negotiation

In the event of any dispute arising out of or relating to the Platform, Services, or these Terms of Service, the parties shall first attempt in good faith to resolve the dispute through informal negotiation within thirty (30) days from the date the dispute arose.

11.3 Mediation

If the dispute is not resolved through negotiation, the parties agree to participate in good faith in the mediation process indicated by the platform, before resorting to arbitration or litigation. The costs and expenses of mediation shall be shared equally by the parties.

11.4 Arbitration

If the parties fail to resolve the dispute through negotiation or mediation, the dispute shall be resolved by binding arbitration under the rules and auspices of a recognized arbitration body, to be held in the jurisdiction in which the Platform operates. The decision of the arbitrator shall be final and binding on the parties and may be entered as a judgment in any court of competent jurisdiction.

11.5 Legal Action

Notwithstanding the foregoing, either party may bring an action in court seeking an injunction or other equitable relief arising out of or relating to the infringement of intellectual property rights or the disclosure of confidential information.

11.6 Fees and Expenses

Unless otherwise agreed in writing, each party shall bear its own costs and expenses, including attorney's fees, in connection with the negotiation, mediation, arbitration, and legal action processes.

 

12. Termination
 

12.1 Termination by Weemotely

Weemotely may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

12.2 Termination by User

Users may terminate their accounts at any time by notifying Weemotely in writing. Termination will be effective upon Weemotely's processing of the written notice. Users will remain liable for all amounts due up to and including the date of termination.

12.3 Effects of Termination

Upon termination, your right to use the Service will immediately cease. Weemotely may remove, or delete, or archive your information, work history, and submitted content from the Platform. Weemotely is not liable for any losses or harm resulting from the termination of services.

12.4 Survival

Provisions of these Terms, which by their nature should survive termination, will survive termination including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

 

13. Data Storage and Retention
 

13.1 Storage of Documents and Files

At Weemotely, we understand the importance of secure and efficient project management. This includes the responsible handling of documents and files uploaded by Clients and Freelancers during project discussions and submissions.

13.2 Retention Period

To maintain the highest standards of data management and to ensure the security and efficiency of our platform, all documents and files related to any project will be stored on our servers during the entire period of the project timeline and for a specific period of three months following the finalization and closure of the project.

13.3 Automatic Deletion

After this three-month period, all files and documents will be automatically deleted from our systems without prior notice. This measure is taken to ensure data privacy and to manage our digital resources effectively.

13.4 User Responsibility

It is the responsibility of both Clients and Freelancers to ensure that any necessary documents and files are downloaded and securely stored on their personal devices or cloud storage before the expiration of the three-month period. Weemotely shall not be held responsible for the loss of any data once deleted from our platform.

13.5 Notification

While we do not provide individual notifications prior to file deletion, this policy serves as a transparent announcement of our data retention practices. Users are encouraged to familiarize themselves with this policy and manage their data accordingly.

13.6 Exceptions

In certain circumstances, such as legal requests or dispute resolutions risen before the closure of the project or less than three months from project closure, specific data may be retained beyond the standard three-month period as required by law or to resolve the dispute effectively. In such cases, only the data necessary for these purposes will be retained, and all other data will be deleted as per our standard policy.

 

14. Miscellaneous
 

14.1 Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the jurisdiction in which Weemotely operates, without regard to its conflict of law principles.

14.2 Entire Agreement

These Terms of Service constitute the entire agreement between the user and Weemotely regarding the use of the Platform and Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Platform and Services.

14.3 Waiver

No failure to exercise, and no delay in exercising, on the part of either party, any right or any power hereunder shall operate as a waiver thereof, nor shall any single or partial exercise of any right or power hereunder preclude further exercise of that or any other right hereunder.

14.4 Severability

If any term, condition or provision of these Terms of Service is held to be invalid, unenforceable or illegal in whole or in part for any reason, that provision shall be enforced to the maximum extent permissible so as to effect the intent of the parties.

14.5 Notices

All notices, requests, consents, claims, demands, waivers, and other communications hereunder shall be in writing and shall be deemed to have been given: (a) when delivered by hand (with written confirmation of receipt); (b) when received by the addressee if sent by a nationally recognized overnight courier; (c) on the date sent by facsimile or e-mail of a PDF document (with confirmation of transmission) if sent during normal business hours of the recipient, and on the next business day if sent after normal business hours of the recipient; or (d) on the third day after the date mailed, by certified or registered mail, return receipt requested, postage prepaid.

14.6 Amendments

Weemotely reserves the right to modify, amend, or change the Terms of Service at its sole discretion. Users are encouraged to review the Terms of Service periodically to stay informed of any changes.

14.7 Assignment

The user may not assign any of its rights or delegate any of its obligations under these Terms of Service without the prior written consent of Weemotely.

14.8 Headings

The headings in these Terms of Service are for reference only and do not affect the interpretation of these Terms of Service.

 

15. Platform Integrity and User Conduct
 

15.1 Prohibition of Off-Platform Transactions

Users of Weemotely, whether Freelancers or Clients, are strictly prohibited from making attempts to contact each other outside of the Weemotely platform for the purpose of soliciting or performing work or making payments. Any communication, transaction, or payment related to projects must be conducted exclusively through the Weemotely platform. In addition, users are not allowed to share contact deatils which also includes revealing any personal information or contact details for the user (client or talent) in any of the description sections of the profile or project details. This includes, but is not limited to, last names, social media profile URLs, email addresses, and phone numbers.

15.2 Consequences of Violation

Any violation of this policy may result in immediate suspension or termination of the user's account and may also subject the user to legal action by Weemotely. Additionally, Weemotely reserves the right to impose fines, claim damages, or seek other remedies from the violating user as permitted by law.

15.3 Reporting Violations and Chat Conduct

Users are encouraged to report any attempts or actions that violate the integrity and trustworthiness of the Weemotely platform immediately. This includes but is not limited to violations occurring within the chat system or in any other interactions facilitated by Weemotely. Prompt reporting assists in upholding the community standards and operational integrity of the platform.
In addition to general policy violations, Weemotely provides a feature that allows users to report an entire chat when they believe there has been a breach of our terms, such as the sharing of contact information or engaging in abusive behavior. Weemotely does not store chat information and conducts reviews only when a chat is reported for suspected violations. Users are expected to utilize the report feature judiciously and in good faith. The misuse of the reporting feature, such as submitting false reports or for purposes of harassment, may lead to an investigation, with potential consequences including the suspension or termination of the user's account.
 

 

16. Respectful User Conduct
 

16.1 Commitment to Respect

Weemotely is committed to creating and maintaining a professional environment where all individuals are treated with respect and dignity. Each user is expected to contribute positively to this environment and to avoid any behavior that could be detrimental to the spirit of collaboration and mutual respect.

16.2 Expected Behavior

Users are expected to conduct themselves professionally and respectfully while interacting with other members of the Weemotely community. This includes all communication and actions within the platform and any external interactions that may impact one's professional relationship with other users on Weemotely.

16.3 Prohibited Conduct

The following behaviors are strictly prohibited on Weemotely's platform:

  • Harassment of any kind, including but not limited to bullying, intimidation, or the use of offensive or demeaning language.
  • Discrimination based on race, ethnicity, gender, sexual orientation, age, disability, religion, or any other protected status.
  • Retaliation against any user who has lodged a complaint or provided feedback.
  • Sharing of another user's personal information without explicit consent.
  • Any form of communication that could be considered as rude, vulgar, or violent.

16.4 Reporting and Enforcement

Users are encouraged to report any behavior that violates Weemotely's policies on user conduct. We take all reports seriously and will investigate them promptly and discreetly. Appropriate action will be taken against any user found to be in violation of these standards, which may include warnings, suspension of account privileges, or termination of the account.

16.5 Responsibility

While Weemotely is dedicated to promoting a respectful environment, it is ultimately the responsibility of each user to ensure that their conduct upholds the standards set forth in these Terms & Conditions. Users are also responsible for the content they post and the interactions they engage in within the Weemotely platform.

 

17. Reviews and Rating
 

17.1 Obligation to Provide Reviews and Rating

Users, both Clients and Freelancers, are required to provide timely and honest Reviews and rating to each other after the completion of a project. This Reviews should reflect the quality of work delivered, the communication throughout the project, and the overall experience of working with the other party.

17.2 Use of Reviews

Weemotely uses Reviews for the improvement of services, determination of User Account status, and for public display on the platform as part of the User’s profile, where applicable.

17.3 Reviews Manipulation

Users are prohibited from manipulating Reviews in any manner, including but not limited to coercing or threatening others for positive Reviews, trading Reviews unfairly, or using secondary accounts to provide self-Reviews.

17.4 Consequences of Inappropriate

Reviews Providing false, misleading, or inappropriately biased Reviews is a violation of Weemotely's policies and may result in penalties, including but not limited to account suspension or termination.

17.5 Dispute of Reviews

In the event a User disagrees with the Reviews received, they may contact Weemotely's support to initiate a review of the Reviews provided. Weemotely will review the circumstances and may mediate to address any discrepancies or issues.

17.6 Non-Retaliation

Users must not engage in retaliation if negative Reviews is received. All Reviews should be addressed constructively, and Users should utilize Weemotely's dispute resolution process if they feel Reviews is unjust.

  • Guidance on Terms & Conditions, Privacy Policy, and platform policies.

Our goal is to respond to all customer inquiries within 1 to 2 business days. However, response times may vary depending on the complexity of the issue and the volume of inquiries received.

18.5 Feedback and Suggestions

Weemotely welcomes feedback and suggestions for improvement. Customer Support is an integral part of our continuous effort to improve our platform and services. Please feel free to share your experience and suggestions with us.

18.6 Limitations
